The agreement, in plain language.

These Terms form a binding contract between you and KwypeSoft, a company registered in France (“we”, “us”, “KwypeSoft”). They cover both the use of the Whispia app and service (Terms of Service) and the licence you get over the app software (End-User Licence Agreement). If you do not accept these Terms, do not create an account and do not use Whispia. By tapping I agree at sign-up, or by continuing to use the app, you confirm that you have read and accepted them.

The agreement

This document, together with our Privacy Policy and Cookie Policy, is the entire agreement between you and KwypeSoft regarding Whispia. It supersedes any prior version. Where the app distribution platform (Apple App Store, Google Play) imposes additional terms, those terms apply to the distribution of the app and, in case of conflict with these Terms about distribution, prevail to the extent of the conflict.

Account and eligibility

To use Whispia you must create an account, be at least 16 years old (or the minimum digital-consent age in your country, where lower), and have legal capacity to enter into a contract. You must give accurate information and keep your credentials confidential. You are responsible for activity on your account. If you suspect unauthorised access, contact us promptly at contact@whispia.app.

Licence to use Whispia (EULA)

Subject to your compliance with these Terms, KwypeSoft grants you a personal, worldwide, non-exclusive, non-transferable, revocable licence to download and use the Whispia mobile application on devices you own or control, for personal, non-commercial use. The app is licensed, not sold.

You agree not to:

  • Copy, modify, reverse-engineer, decompile or disassemble the app, except to the extent permitted by mandatory law (e.g. Article 6 of EU Directive 2009/24/EC).
  • Rent, lease, lend, sell, redistribute or sublicense the app or your account.
  • Remove or alter any proprietary notices, trade marks or copyright marks.
  • Use the app in connection with any automated system, scraper, or bulk-extraction tool.
  • Use the app on jail-broken or rooted devices to bypass payment, security or content controls.

The licence terminates automatically if you breach these Terms or close your account.

Subscriptions, tokens and billing

Whispia offers a free tier and a paid Premium tier. The current plan and pricing are shown in the app and on the pricing page. Subscriptions are billed via Apple or Google through their in-app purchase systems and managed on our side by RevenueCat, in accordance with their terms. By starting a subscription you authorise the relevant store or processor to charge your payment method on each renewal.

Premium includes a monthly token allowance used to power AI generation. Tokens are an internal accounting unit; they are not money, not a security, not transferable, have no cash value, and cannot be redeemed for cash. Unused tokens may roll over up to the cap stated in the app. Tokens expire on account closure or non-payment.

Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period via the relevant store. Prices may change with at least 30 days' notice; if you do not accept a price change, you may cancel before it takes effect.

Cancellation and refunds

EU right of withdrawal. If you are a consumer in the EU, you have a 14-day right to withdraw from a paid subscription under Articles L. 221-18 and following of the French Consumer Code. By starting to use Premium content within those 14 days, you expressly request immediate performance of the service and acknowledge that you lose your right of withdrawal once the service has been fully performed (Article L. 221-28 13°). For digital content delivered immediately on purchase (e.g. a token top-up that you start using), the right of withdrawal is also lost when performance begins with your prior express consent.

Outside the right of withdrawal, refund requests are handled by the store you bought through (Apple App Store or Google Play). KwypeSoft cannot directly issue refunds for store-billed subscriptions. For any other billing question, contact contact@whispia.app.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period; you keep Premium access until then.

AI-generated content

Whispia uses third-party generative-AI services to produce stories, voice narration, and related content on demand. Generative AI is by nature probabilistic. Even with our content-safety pipeline, prompt-and-output filters, and human-reviewed Originals, generated material may sometimes:

  • Be of lower quality than expected: repetitive, awkward, abruptly ending, or stylistically off.
  • Contain factual mistakes, fabricated names, anachronisms, or fictional details presented as fact (“hallucinations”).
  • Drift from your prompt, or only loosely match the mood / theme / length you requested.
  • Occasionally produce unexpected, uncomfortable or otherwise unwelcome content, despite our guard rails. We do not guarantee any specific content outcome.
  • Vary in voice quality, pacing or pronunciation due to the underlying voice provider.

You accept the variability of AIBy using the AI generation features you acknowledge and accept that AI output is variable and may not meet your expectations on every run. AI-generated content is not professional medical, psychological, legal or financial advice and must not be used as a substitute for it. Whispia is a relaxation aid, not a treatment for any condition.

If you ever encounter generated content that is unsafe, inappropriate or upsetting, please report it from the player screen or by writing to contact@whispia.app. We review every report and use it to improve the safety pipeline.

Learn mode and factual accuracy

Learn mode produces educational stories — covering subjects such as history, science, and the natural world — that are AI-generated and grounded in, and checked against, external online sources, with a list of those sources shown alongside each story. Despite this research-and-fact-check step, Learn-mode content may still contain errors, omissions, oversimplifications, or outdated information, and is not guaranteed to be accurate or complete. It is provided for general interest and curiosity only, and is not a substitute for professional, educational, or medical advice.

Review it before you rely on it — or share it with a childYou are responsible for reviewing Learn-mode content, including its accuracy and its age-appropriateness, before relying on it or sharing it with a child. The sources shown with each story are there to help you verify it.

Ownership and your content

Our content. Whispia, the app, the Originals catalogue, the Whispia name, logo, brand, design system, voice presets and accompanying materials are owned by KwypeSoft or its licensors and are protected by copyright, trade-mark, and other intellectual-property laws. Nothing in these Terms transfers any of those rights to you.

Your prompts. You retain whatever rights you have in the prompts you provide. You grant KwypeSoft a worldwide, non-exclusive, royalty-free licence to use those prompts for the sole purpose of generating the requested output, operating the service, and (in aggregated, de-identified form) improving safety and quality.

Your generated story text. Subject to these Terms and to the terms of our AI providers, KwypeSoft assigns to you any rights it may have in the specific story text generated from your prompts. You paid the tokens to produce that text, so you may keep it, edit it, share it, and reuse it in your own projects, including for commercial purposes. The Whispia Originals catalogue is a separate body of work and remains entirely the property of KwypeSoft.

Voice-synthesised audio. The audio narration of your stories is produced by third-party voice providers (currently OpenAI, Azure Speech, Google Gemini, Fish Audio, or ElevenLabs). Their synthesis models and voice presets are licensed to us only for playback inside Whispia and for your personal, non-commercial use. You may listen to, save, and play back the audio for your own enjoyment, but you may not:

  • Sell, license, rent, broadcast, or otherwise commercialise the audio.
  • Redistribute the audio as a stand-alone work, podcast, audiobook, or compilation.
  • Use the audio to train, fine-tune, or evaluate any speech, voice-cloning, or voice-conversion system.
  • Use the audio to imitate, impersonate, or simulate any real or fictional person.

If you want a commercial-use audio narration of a story you generated, you can re-narrate the text yourself or have it produced under a commercial-use voice licence directly with the relevant provider — your story text is yours to use that way (see the paragraph above).

You also acknowledge that:

  • Identical or similar outputs may be generated for other users; we make no exclusivity claim and you may not either.
  • Copyright protection on AI-generated material is uncertain and varies by jurisdiction; we make no warranty as to its protectability.
  • You are responsible for how you use the output.

Acceptable use

You agree not to use Whispia to generate, request, store, or distribute content that:

  • Sexually exploits or endangers a minor, or sexualises minors in any way.
  • Promotes self-harm, suicide, eating disorders, or violence against others.
  • Contains real-person sexual content, harassment, doxxing, or hate speech against a protected group.
  • Aims to extract training data, bypass safety controls, jailbreak, or impersonate the system.
  • Infringes copyrights, trade marks, privacy rights, or any third-party right.
  • Breaks any applicable law.

We reserve the right to refuse a generation, remove content, or suspend or terminate accounts that breach these rules, with or without prior notice depending on severity.

Family profiles and child use

Whispia accounts are for adults. A parent or legal guardian may create one or more child profiles within their account, choosing the appropriate age band (0–3 or 3–10). By creating a child profile, you confirm you are the parent or legal guardian and consent, on behalf of the child, to the limited processing described in the Privacy Policy.

Children must not generate AI stories on their own; AI generation is gated behind a parent passcode. Originals available to a child profile are filtered to that age band. Despite these measures, generative content is variable (see section 06); parents are responsible for supervising listening sessions and may disable the AI generation feature entirely from family settings.

Third-party stores and services

The app is distributed through Apple App Store and Google Play. The standard EULA of each store applies in addition to ours, and prevails over inconsistent provisions of these Terms regarding distribution, refunds, and the relationship between you and the store. Apple Inc. and Google LLC are third-party beneficiaries of these Terms with respect to the app on their platform and may enforce them against you.

We integrate with third-party services (OpenAI, Microsoft Azure, Perplexity, ElevenLabs, Fish Audio, RevenueCat, Apple, Google, Datadog). Your use of those services is also governed by their own terms; we are not responsible for their acts or omissions, but we choose them carefully and require contractual safeguards.

Changes to the service and these Terms

The service is iterative. We may add, change or remove features, content categories, voices, or pricing tiers, and update these Terms accordingly. For material changes affecting your rights or your subscription, we will give at least 30 days' notice in-app or by email. Continued use of the service after the effective date of a change constitutes acceptance of the new Terms; if you do not accept, you may close your account.

Disclaimers

To the maximum extent permitted by law, the Whispia service and the app are provided “as is” and “as available”. We do not warrant that the service will be uninterrupted, error-free, secure against intrusion, or that any specific output, voice, or story will meet your expectations. We do not warrant that AI output will be accurate, suitable, or fit for any particular purpose. Whispia is intended for relaxation and entertainment; it is not a medical device and is not a substitute for professional advice or treatment. If you have a sleep disorder, anxiety disorder, depression, or any other condition, please consult a qualified professional.

Whispia depends on third-party AI providers (text-generation models, voice-synthesis models), payment platforms, and hosting and observability infrastructure. Service availability, latency, generation quality, voice rendering, feature behaviour, and pricing of upstream providers can vary or be temporarily disrupted at any time, and some features may be paused, changed, or removed in response. You acknowledge that this variability is inherent to AI-powered services that rely on third-party infrastructure, and agree that occasional unavailability or quality variability shall not, by itself, give rise to a claim against KwypeSoft, beyond the statutory remedies preserved in the next paragraph.

Nothing in this section limits any non-excludable consumer rights you may have under French or EU law, including the legal warranty of conformity (garantie légale de conformité) under Articles L. 217-3 and following of the French Consumer Code, and the warranty against hidden defects (garantie des vices cachés) under Articles 1641 and following of the French Civil Code.

Limitation of liability

To the maximum extent permitted by law, KwypeSoft, its directors, employees, and agents shall not be liable for indirect, incidental, special, consequential, or punitive damages, lost profits, lost data, lost goodwill, or substitute-service costs, arising out of or relating to your use of Whispia, even if advised of the possibility. KwypeSoft's total aggregate liability arising out of or relating to these Terms or your use of the service shall not exceed the greater of (a) the amount you paid to KwypeSoft for the service in the 12 months preceding the event giving rise to the claim, or (b) fifty euros (€50).

Nothing in this section excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud, or for gross negligence or wilful misconduct.

Indemnity

If a third party brings a claim against KwypeSoft because of something you did, you agree to defend KwypeSoft against that claim and to reimburse us for the loss, damage, or reasonable legal fees we actually incur. This applies only to claims arising specifically from:

  • content you submit, prompt, or generate that infringes a third party's intellectual-property, privacy, or publicity rights;
  • your wilful or knowing breach of section 08 (Acceptable use) or of applicable law;
  • your commercial use, redistribution, or sale of voice-synthesised audio in breach of section 07 (Voice-synthesised audio); or
  • your use of the service on behalf of a business or another person without their authority.

This obligation does not apply to acts attributable to KwypeSoft, its sub-processors, or its AI providers, and it does not limit, override, or substitute for any non-waivable consumer rights you have under French or EU law, including any statutory cap on consumer liability or any consumer-protective interpretation of these Terms. We may, at our expense, assume the exclusive defence and control of any matter for which you owe us indemnification, in which case you agree to reasonably cooperate.

Governing law and disputes

These Terms are governed by the law of France, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Any dispute relating to these Terms or the service shall first be raised with us at contact@whispia.app so that we can try to resolve it amicably. If we cannot, you may bring the dispute before the competent French courts. Consumers retain the right to bring an action before the courts of their country of residence and to benefit from the mandatory protective provisions of their local law. Consumers also have access to the European Commission's online dispute resolution platform.

Miscellaneous

  • Severability. If any provision is found unenforceable, the rest of the Terms remain in force.
  • No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
  • Assignment. You may not assign these Terms; we may assign them to an affiliate or a successor in connection with a merger, acquisition, or sale of assets.
  • Force majeure. Neither party is liable for failure to perform due to events beyond its reasonable control.
  • Notices. We may send notices in-app or by email to the address on your account; you accept that as a valid written notice.
  • Language. These Terms are available in English and French. In case of conflict, the French version prevails for consumers domiciled in France.

User-provided narration content

Whispia offers a feature (“Bring Your Own Text”) that allows you to submit your own written text for narration via our AI Text-to-Speech engine. By submitting your own narration text, you acknowledge and agree that:

  1. Moderation. All submitted text is subject to automatic content moderation. We reserve the right, at our sole discretion, to decline to generate audio for any text that we determine, through automated or manual review, breaches our Acceptable Use Policy or applicable law.
  2. Responsibility. You retain full responsibility for the content of any text you submit. You represent and warrant that you have the legal right to submit, narrate, and use the resulting audio for your intended purposes; that the text does not infringe on any third party's intellectual property, privacy, publicity, or other rights; and that the text does not contain unlawful, defamatory, or harmful content.
  3. Liability disclaimer. To the maximum extent permitted by applicable law, neither Whispia nor KwypeSoft shall be liable for any direct, indirect, incidental, consequential, or punitive damages arising from or relating to the content of user-provided narration text or the resulting generated audio. The audio is provided as-is, based solely on the text you supply.
  4. Cost. Token cost for user-provided narration is calculated from the character count of your submitted text and the chosen voice's per-character pricing tier. No language-model generation fee applies.
  5. Storage. User-provided narration text is stored alongside your generated audio in your account, subject to our standard data retention policy described in our Privacy Policy.
  6. Eligibility. This feature is available to Premium subscribers only and may be disabled for individual accounts at our sole discretion in cases of abuse or policy violation.

Voice cloning

18.1 Right to clone

The Voice Cloning feature lets you upload an audio sample and create a synthesised voice (a “Clone”) that you can use to narrate audio stories within Whispia. You may only create a Clone of a voice for which you hold the necessary rights — your own voice, or the voice of a person who has given you written consent for this specific purpose. Whispia does not verify these rights at upload time; you bear sole legal responsibility for the rights you assert.

18.2 Personal use only

You may use Clones only to generate audio you consume yourself within Whispia. You may not (a) export the synthesised audio for redistribution, (b) use a Clone to impersonate any individual outside Whispia, (c) use a Clone for any commercial purpose, including without limitation broadcasting, advertising, or training other AI models.

18.3 Provider

Clones are created and stored on a third-party voice-synthesis provider (today: Fish Audio, https://fish.audio; in the future, additional providers we may onboard). Your audio sample is uploaded to the provider for the sole purpose of training the Clone. We do not retain the audio sample after upload unless you explicitly request retention for support reasons. Synthesised audio bills against your Whispia subscription per the same per-character / per-byte rates as catalogue voices.

18.4 Whispia revocation right

Whispia may delete any Clone at any time, with or without notice, when:

  • a third party asserts a verified takedown right regarding the cloned voice;
  • we detect misuse, including violation of §18.2;
  • the synthesis provider terminates or restricts the underlying model;
  • we reasonably believe revocation is required by law or by the synthesis provider's terms.

We do not refund credits or subscription fees for revocations exercised in good faith. If you believe a revocation was made in error, contact support@whispia.app and we will review within 14 days.

18.5 Re-creation

You may not recreate a Clone of a voice for which we have previously exercised a revocation right. Doing so is a material breach of these Terms and is grounds for suspension or termination of your Whispia account.

18.6 User-initiated deletion

You may delete any of your Clones at any time, in-app or by request to support@whispia.app. We dispatch the deletion request to the synthesis provider on a best-effort basis. Where the provider is temporarily unavailable, we record the pending deletion in our audit log and retry until the provider confirms.

18.7 Account-deletion cascade

When you close your Whispia account, every Clone you have created is queued for deletion at the synthesis provider. The same best-effort + audit-and-retry semantics from §18.6 apply.

18.8 Free users

Voice cloning is a Premium feature by default. We may grant Voice Cloning to selected Free users (testers, content creators with whom we partner) at our discretion via a per-user override. The granted state may be revoked at any time without notice; existing Clones remain accessible and revocable per §18.6.

18.9 Sharing

Audio stories generated with a Clone may not be shared via the Whispia Sharing feature. This restriction is enforced server-side at the time of share creation.

18.10 Provider terms incorporated

Your use of the Voice Cloning feature is subject to the relevant synthesis provider's terms of service in addition to these Terms. To the extent the provider's terms impose stricter constraints than these Terms, the stricter constraint applies.

Today's provider terms:

18.11 Severability and continuity

If any part of this section is held unenforceable in a particular jurisdiction, the remainder of the section continues in effect. Pre-existing Clones survive minor non-substantive revisions of this section; substantive revisions (changes to the rights granted to or asserted against the user) require re-acknowledgement at next use, mediated by the in-app ConsentTextVersion mechanism.

Bring Your Own Keys (BYOK)

19.1 Overview

The Bring Your Own Keys feature (“BYOK”) lets you connect your own developer API keys for supported third-party language-model (LLM) and text-to-speech (TTS) providers — for example OpenAI, Microsoft Azure, ElevenLabs, Fish Audio, or comparable providers we may onboard from time to time. When a BYOK key is configured for a provider, requests for that capability are routed to the provider through Whispia on your behalf using your key, and usage is billed by the provider directly against your provider account, not against your Whispia token allowance.

19.2 Eligibility and activation

BYOK is opt-in. You activate it from the in-app settings by pasting a valid API key for the provider of your choice. The list of supported providers, the supported capabilities for each provider (text generation, voice synthesis, voice cloning, etc.) and any per-provider feature gating are shown in-app and may change over time. Whispia may make BYOK available to Free and Premium accounts, or restrict it to a specific tier or region, at our discretion.

19.3 Your responsibilities

By configuring a BYOK key, you represent and warrant that:

  • You are the lawful holder of the API key, or are duly authorised by the holder to use it inside Whispia.
  • Your use of Whispia with that key complies with the provider's terms of service, acceptable-use policy, content policy, rate limits, regional restrictions, and any commercial-use rules that may apply to the underlying models and voices.
  • You will keep your key confidential, rotate or revoke it if compromised, and remove it from Whispia if you no longer wish it to be used.
  • You accept that all charges, taxes, overage fees, and rate-limit consequences incurred on your provider account through your key are your sole responsibility.

19.4 Key storage and use

Keys you provide are encrypted at rest in our systems and used solely to authenticate requests to the corresponding provider on your behalf. We do not display the full key back to you after entry, do not export or sell it, and do not log it in plain text. You can rotate or remove a key at any time from the in-app settings. When you remove a key, any in-flight requests already dispatched to the provider will complete; subsequent requests for that provider will fall back to the standard Whispia-managed pipeline (subject to your token allowance), or fail closed if no fallback is available.

19.5 Whispia is a relay, not a reseller

Under BYOK, you have a direct contractual relationship with the underlying provider for the requests authenticated with your key. Whispia acts only as a technical relay: we transmit your prompt or text to the provider over your authenticated connection and return the response inside the app. Whispia does not act as a merchant of record, payment processor, or distributor of the provider's service for those requests. Service availability, latency, output quality, content moderation, billing, refunds and support for BYOK-routed traffic are governed by the provider's own terms.

19.6 No Whispia tokens consumed

Generations performed through a BYOK key for a given capability do not consume your Whispia token allowance for that capability. A small Whispia-side overhead (request orchestration, content moderation, audit logging) is included at no extra token cost as part of your subscription. If a single generation requires multiple capabilities and only some are covered by a BYOK key, the un-covered capabilities continue to consume Whispia tokens at the standard rate, and the cost preview shown in-app reflects that split.

19.7 Safety pipeline still applies

Whispia's content-moderation and safety pipeline (section 06, section 08, section 17) continues to apply to text, prompts and audio routed through Whispia under BYOK. We may decline to dispatch a request, refuse to play back generated audio, or remove generated content that breaches our Acceptable Use Policy, even where the underlying provider would not. This is independent of, and in addition to, any moderation the provider performs on its own.

19.8 Liability disclaimer for BYOK

To the maximum extent permitted by law, KwypeSoft is not liable for: (a) charges, overages, taxes, or billing disputes incurred on your provider account through your key; (b) provider-side outages, latency, deprecations, or quality variability; (c) moderation, refusal, or downgrade of a request by the provider; (d) loss of access to a Clone, voice, or model resulting from a change to the provider's account, key, or terms; (e) compromise of a key as a result of your own action (e.g. pasting the key in an untrusted context outside Whispia); or (f) any consequence of the underlying provider's training, retention or sub-processing practices, which are governed by your direct agreement with that provider.

Nothing in this section excludes or limits our liability where it cannot be excluded or limited by law, including the non-excludable consumer-protective provisions referenced in section 13 and section 12.

19.9 Compliance with provider terms

Your use of a BYOK key is also subject to the provider's own terms of service, privacy policy, acceptable-use policy and any applicable model-specific licence. To the extent the provider's terms impose stricter constraints than these Terms, the stricter constraint applies. You are responsible for reading and complying with those terms; Whispia does not undertake to monitor or enforce them on the provider's behalf.

19.10 Whispia's right to suspend BYOK

We may disable BYOK on your account, with or without notice, when:

  • we detect misuse of the feature, including attempts to circumvent our safety pipeline, our Acceptable Use Policy, or applicable law;
  • a provider notifies us of a security or compliance issue with the configured key;
  • we reasonably believe the key has been stolen, leaked, or used without the rightful holder's authority;
  • the provider terminates, restricts, or materially changes the relevant API in a way that makes safe relay no longer practical.

Suspension of BYOK does not, by itself, suspend the rest of your Whispia account; covered capabilities will fall back to the Whispia-managed pipeline where available.

19.11 Account-deletion cascade

When you close your Whispia account, every BYOK key stored in your account is securely deleted from our systems. We do not retain a copy. We do not, however, revoke the key on the provider's side — that remains your responsibility, and we recommend you rotate or revoke the key with your provider after closing your Whispia account.

19.12 Changes to supported providers

We may add, replace or remove supported BYOK providers and capabilities at any time, including in response to changes in a provider's API, terms or commercial availability. For material changes that remove an active capability we will give in-app notice where reasonably possible.

19.13 Severability and continuity

If any part of this section is held unenforceable in a particular jurisdiction, the remainder of the section continues in effect. Substantive revisions of this section (changes to the rights granted to or asserted against the user under BYOK) require re-acknowledgement at next use, mediated by the in-app ConsentTextVersion mechanism.

Relaxation, breathing & body-focused practices

20.1 Nature of the content

Whispia provides guided audio for relaxation, including Progressive Muscle Relaxation (PMR), Autogenic Training, Yoga Nidra, Guided Imagery, breathing exercises, and similar body-focused practices. These sessions are designed for general well-being, calm, and sleep onset. They are not medical treatment, not psychotherapy, and not a substitute for professional care.

20.2 You decide whether a session is right for you

Some practices involve voluntary muscle tension (PMR), passive concentration that may produce sensations of heaviness, warmth, dizziness, or autonomic rebound (Autogenic Training), modified breathing rhythms, or extended periods lying still. You are solely responsible for deciding whether a given session is appropriate for your physical and mental health, and for stopping at any time if you feel discomfort, pain, panic, or any unusual sensation.

20.3 Conditions that require medical clearance before practising

You must consult a qualified healthcare professional before using sessions in this category if you have, or suspect you have, any of the following: uncontrolled hypertension or other cardiovascular disease; recent surgery, injury, or muscle spasm; chronic pain, fibromyalgia, or active trigger points; epilepsy or seizure disorders; psychotic disorders (including schizophrenia); severe depression, suicidal ideation, dissociative disorders, or active psychiatric crisis; pregnancy with complications; diabetes requiring close monitoring. Autogenic Training in particular is contraindicated for psychotic disorders and severe depression, and may produce, in vulnerable users, dizziness, disorientation, panic, or rare hallucinatory experiences. If any session triggers such effects, stop immediately and consult a healthcare professional.

20.4 Practice environment

Do not listen to relaxation sessions while driving, operating machinery, walking in traffic, swimming, in a bath, near stairs, or in any situation where reduced alertness or falling asleep would be unsafe. Practise in a stable seated or lying position. You are responsible for choosing a safe environment.

20.5 No therapeutic outcome guaranteed

Whispia makes no representation or warranty that any session will produce sleep, reduce anxiety, lower blood pressure, alleviate pain, treat insomnia, or produce any other outcome. Reactions to relaxation audio vary widely. Some users experience paradoxical effects (increased anxiety, intrusive thoughts, hyperawareness of sensation). Such reactions are reported in clinical literature and do not constitute a defect of the service.

20.6 You assume the risks of practice

To the maximum extent permitted by applicable law, you acknowledge and accept the inherent risks of body-focused relaxation practices and assume sole responsibility for your decision to use this content. You agree to indemnify and hold harmless KwypeSoft and its affiliates against any third-party claim arising from your practice or from advice you give to a third party based on a Whispia session.

20.7 Mandatory consumer protections preserved

Nothing in this section limits or excludes any liability that cannot be limited or excluded under the consumer-protection law of your country of residence (in particular, liability for death, personal injury caused by gross negligence or wilful misconduct, or for breach of warranties imposed by mandatory consumer law). The waivers and disclaimers in section 13 and section 14 apply subject to those rights.
